1. Introduction
Welcome to MenuBank ("we," "our," or "us"). We are committed to protecting your personal information and your right to privacy. This Privacy Policy outlines how Musa Erdem Mecit ("we", "us", or "our") collects, uses, protects, and discloses your information when you use the MenuBank mobile application on iOS and Android ("the App"), distributed via the Apple App Store and Google Play Store.
By using the App, you agree to the collection and use of information in accordance with this policy.
2. Information We Collect
To provide and improve our service, we collect the following types of information:
- Account Information: When you sign up via Google or Apple, we receive basic profile information such as your name, email address, and profile picture.
- Location Data: With your explicit permission, we collect precise or approximate location data to show you the menus and restaurants nearest to you. You can enable or disable location services within your device settings at any time.
- Camera Access: With your explicit permission, the App accesses your camera solely for the purpose of scanning QR codes that link to restaurant menus. Camera images are not stored or transmitted to our servers.
- User-Generated Content: We store the photos, menus, text, reviews, and restaurant data you upload to the App.
- Payment Information: For auto-renewable subscriptions, payments are processed directly by the Apple App Store (on iOS) or Google Play Billing (on Android). We do not collect, process, or store your credit card or financial information. We only receive a transaction token, receipt, and purchase status to unlock premium features such as the verified-owner badge.
- Push Notification Tokens: If you grant notification permission, we collect a device-specific push token (Apple APNs on iOS or Firebase Cloud Messaging on Android) used solely to deliver app-related notifications.
- Advertising Identifiers and Ad-Related Data: When you grant consent through the in-app prompt (Apple App Tracking Transparency on iOS, or the Google User Messaging Platform / IAB TCF consent dialog on Android in applicable regions), the App—via our advertising partner Google AdMob—may access your device's Advertising Identifier (IDFA on iOS / Android Advertising ID on Android) together with coarse device and interaction signals (device model, operating system version, general region, timestamps, and interactions with advertisements such as impressions and clicks). If you decline the prompt or live in a region where consent is not required, no tracking identifier is shared and only non-personalized advertisements are requested.
- Usage Data: We may collect automatic diagnostic and usage data (e.g., app crashes, feature usage, anonymous device model and OS version) to improve the reliability and performance of the App.
3. How We Use Your Information
We use the collected data for various purposes, including:
- To provide, maintain, and monitor the usage of the App.
- To manage your Account and subscriptions.
- To provide customer support and respond to your inquiries.
- To enforce our terms, conditions, and policies.
- To detect, prevent, and address technical issues or fraudulent behavior.
- To display advertisements within the App (personalized advertisements when ATT permission is granted; non-personalized advertisements otherwise) and to measure basic advertising performance (impressions, clicks, and fill rate).
4. Sharing of Information
We do not sell, rent, or trade your personal information to third parties. We may share information under the following limited circumstances:
- Service Providers: We use trusted third-party services to facilitate our services, including Supabase (database, authentication, storage, and edge functions), Google APIs (Places, Maps, and Sign-In), Apple Sign In, Apple App Store and Google Play Billing (in-app purchases and subscriptions), Google AdMob (advertising), Apple Push Notification service and Firebase Cloud Messaging (notifications), and Expo / EAS (build and over-the-air update infrastructure). These third parties are bound by their own privacy policies and process data only as necessary to provide their services.
- Advertising Partners (Google AdMob): The App displays advertisements served by Google AdMob. When the in-app consent prompt (Apple ATT on iOS, or Google UMP / IAB TCF on Android in applicable regions) is accepted, Google may receive your Advertising Identifier (IDFA / AAID) and basic device/interaction signals to serve personalized advertisements and to measure ad performance. When consent is declined or unavailable, Google only receives non-personalized, contextual advertising requests. - Legal Compliance: We may disclose information if required to do so by applicable laws, legal processes, or to protect the rights and safety of MenuBank, our users, or others.
5. Data Security
We implement robust, industry-standard security measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. However, please remember that no method of electronic transmission or storage is 100% secure, and we cannot guarantee its absolute security.
6. Data Retention and Deletion
We keep your personal information only as long as necessary to fulfill the purposes outlined in this Privacy Policy. You have the right to request the deletion of your account and personal data. You can delete your account directly through the App settings (Profile > Delete Account), which will permanently remove your personal and identifiable data from our active databases.
7. Children's Privacy
Our App is not intended for use by children under the age of 13. We do not knowingly collect personally identifiable information from children under 13. If we discover that a child under 13 has provided us with personal information, we will delete it from our servers immediately.
8. Advertising, Tracking, and App Tracking Transparency (ATT)
The App is supported by in-app advertisements delivered through Google AdMob. To comply with Apple's App Tracking Transparency framework and with GDPR/ePrivacy rules in the European Economic Area and the United Kingdom, the App applies the following practices:
- ATT Prompt (iOS 14.5+): On first launch (after the splash screen), iOS presents the native "Allow [App] to track your activity across other companies' apps and websites?" prompt. Your choice is recorded by the operating system and can be changed at any time via Settings > Privacy & Security > Tracking > MenuBank, or Settings > MenuBank > Allow Tracking.
- If you select "Allow": Google AdMob may use your device's Advertising Identifier (IDFA) to request personalized advertisements and to measure ad performance (impressions, clicks, conversions). This identifier is a random, user-resettable string and is not your name, email, or phone number.
- If you select "Ask App Not to Track": No Advertising Identifier is shared. The App explicitly requests non-personalized, contextual advertisements only. Core App functionality is unaffected.
- Google User Messaging Platform (UMP) — GDPR / EU Consent: For users located in the European Economic Area, the United Kingdom, or Switzerland, the App additionally presents a Google-certified GDPR consent form before loading advertisements. You may grant or withhold consent for individual advertising purposes and vendors, and you can reopen the consent form at any time from the App's Profile screen.
- No Cross-Context Profiling Outside Advertising: MenuBank itself does not build cross-site advertising profiles about you. We do not sell or share personal information for cross-context behavioral advertising as defined by the California Consumer Privacy Act (CCPA/CPRA). The Advertising Identifier is handled exclusively by Google AdMob under its own policies.
- Children: Advertisements shown in the App are configured with Google's content rating set to "PG" or stricter, and tag-for-child-directed-treatment settings are respected when applicable. The App is not intended for children under 13 (see Section 10 below).
- Opting Out Further: In addition to the ATT prompt, you can limit ad tracking on iOS via Settings > Privacy & Security > Apple Advertising, and you can reset your Advertising Identifier at any time. On Android, equivalent controls are available under Settings > Google > Ads.
9. Changes to This Privacy Policy
We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date. You are advised to review this Privacy Policy periodically for any changes.
10. COMPREHENSIVE DISCLAIMER REGARDING MENU CONTENT, THIRD-PARTY INFORMATION, AND ABSOLUTE ZERO LIABILITY
This section supplements and reinforces the disclaimers stated in our Terms of Use. By using MenuBank, you expressly acknowledge, understand, and agree to the following:
- Nature of the Platform: MenuBank operates strictly and exclusively as a third-party informational aggregator, indexer, and user-driven sharing platform. MenuBank does NOT create, manufacture, prepare, serve, or sell any food, beverage, or product listed within the App.
- Origin of Menu Data: The menus, prices, food descriptions, photographs, and all restaurant-related information available in the App are sourced ENTIRELY from publicly available QR menus, physical menus, and publicly accessible menu lists of the respective businesses. Almost all of this content is contributed, photographed, uploaded, and added by independent users of the App—NOT by MenuBank or its developers. MenuBank does not independently verify, create, or endorse any menu content.
- Publicly Available Information: All menus displayed in the App have already been made completely public by the respective businesses and actively shared with their customers in physical or digital form. MenuBank solely indexes factual information (such as food items and prices) that is already in the public domain. No private, confidential, or proprietary business information is knowingly collected or disclosed by MenuBank.
- No Affiliation, Agency, or Endorsement: MenuBank is an entirely independent platform. It is NOT affiliated with, endorsed by, sponsored by, partnered with, or acting as an agent for any restaurant, business, or entity whose menu appears in the App. The presence of a menu does not imply any commercial relationship, recommendation, quality guarantee, or endorsement of any kind.
- "As Is" Information — No Guarantees Whatsoever: All menu content is provided on a strictly "AS IS" and "AS AVAILABLE" basis. MenuBank makes ABSOLUTELY NO warranty, representation, or guarantee—express or implied—regarding the accuracy, completeness, currentness, reliability, or fitness for any purpose of any menu, price, allergen information, nutritional data, ingredient list, operating hour, or description displayed in the App. Users must independently verify all information directly with the respective business before making any decisions based on App content.
- Health, Allergen, and Dietary Disclaimer: MenuBank explicitly disclaims any and all liability for health-related consequences, allergic reactions, food poisoning, dietary issues, or any physical or psychological harm resulting from reliance on menu information displayed in the App. Users with food allergies, intolerances, or specific dietary requirements MUST contact the respective business directly to confirm ingredients and preparation methods. MenuBank bears no responsibility for any adverse health outcome.
- Price and Availability Disclaimer: Prices, availability, and menu items displayed in the App may be outdated, incorrect, or no longer available at the respective business. MenuBank does not guarantee the accuracy of any pricing information and shall not be held liable for any price discrepancy between the App and the actual restaurant.
- Absolute Zero Liability — Total Legal Protection: To the absolute maximum extent permitted by the laws of the Republic of Turkey and all applicable international laws, MenuBank, its founder (Musa Erdem Mecit), developers, employees, affiliates, agents, successors, assigns, and representatives accept ABSOLUTELY NO LEGAL RESPONSIBILITY, LIABILITY, OR OBLIGATION—whether arising in contract, tort (including negligence and gross negligence), strict liability, statutory duty, consumer protection law, intellectual property law, or any other legal theory—for any loss, damage, expense, claim, or harm of any kind arising from or related to the addition, display, accuracy, validity, copyright status, trademark status, intellectual property status, or use of menus and restaurant information within the App. This includes, without limitation, any direct, indirect, incidental, special, punitive, exemplary, or consequential damages (including but not limited to loss of profits, revenue, data, business opportunities, goodwill, or reputation).
- Waiver of Claims — All Parties: By using the App, you irrevocably and unconditionally waive any and all rights to bring any claims, lawsuits, class actions, collective actions, arbitration proceedings, or legal demands of any nature against MenuBank, its developer, or affiliates regarding the menus and their content. This waiver explicitly and without limitation applies to: (a) individual users of the App; (b) restaurant or business owners, operators, and their authorized representatives; (c) franchise holders and brand licensees; (d) local, regional, national, or international governmental authorities; (e) regulatory bodies and enforcement agencies; (f) consumer protection agencies and ombudsmen; (g) intellectual property rights holders; and (h) any other third party or entity claiming any interest.
- Notice and Takedown Policy: If a business owner, authorized representative, intellectual property rights holder, or any party has a valid complaint, copyright/trademark infringement claim, or wishes their menu to be removed from the App, they may contact us at mecitmusa@gmail.com. MenuBank commits to the prompt removal of disputed content upon receipt of a valid, written request. Such removal is performed as a courtesy and good-faith measure and does NOT constitute an admission of liability, fault, infringement, or wrongdoing of any kind.
- Indemnification: You agree to fully indemnify, defend, and hold harmless MenuBank, its founder (Musa Erdem Mecit), developers, employees, and affiliates from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees and court costs) arising out of or related to: (a) your use or misuse of the App; (b) your uploading of any content to the App; (c) your violation of these Terms or this Privacy Policy; (d) your violation of any rights of any third party through the App; or (e) any dispute between you and any restaurant, business, or third party arising from information displayed in the App.
- Severability: If any provision of this Disclaimer is held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
